A significant legal test case is scheduled to be heard in the High Court at the Royal Courts of Justice in London, starting in October 2025. This case challenges the Ministry of Defence’s (MoD) handling of military hearing loss claims. Nexa Law is able to include its clients in the case, meaning those affected by noise-induced hearing loss during service may have an opportunity to benefit from the legal framework being established.
The MoD has previously contested many military hearing loss claims, often arguing that cases were brought too late or disputing the level of noise exposure. In this test case, the MoD has accepted that it had a duty of care to service personnel. As a result, claimants will primarily need to show that their hearing loss was caused by their military service rather than facing additional legal challenges.
Nexa Law can assist service members who may be eligible to have their cases included within this process. As part of the test case, a structured system is being introduced to assess eligibility and
compensation amounts, based on medical evidence and service history. Those who instruct Nexa Law now may be able to take advantage of this system, streamlining their claims.
It’s important to note that not all law firms handling hearing loss claims are participating in this test case. Therefore, there is no assurance that the MoD will make similar concessions for clients of other
firms. By participating in this test case, Nexa Law is helping to ensure that more service personnel receive the recognition and financial redress they deserve.
If you believe your hearing has been affected by military service, Nexa Law can assess your case and advise you on the next steps.
