Family Law – the importance of advice

Nexa consultant Elizabeth Matfin is  a Solicitor and Collaborative Lawyer, specialising in family law, debt recovery and disputes.  Here Elizabeth discusses family law and the importance of the right support and guidance during the divorce process.

The concept of fair divorce and justice is a complex and multifaceted issue. In the UK, the Divorce, Dissolution and Separation Act 2020 came into force on 6 April 2022, which reforms the divorce process to remove the concept of fault. The changes aim to simplify current practices and reduce conflict between couples .

In terms of advice, a family law solicitor can support you through the whole process of getting divorced or dissolving a civil partnership, making it as simple and stress-free as possible by listening to you, discussing your options with you, and telling you where you stand and what your rights are so you can make informed choices. We would always recommend taking early advice to help put your mind at ease and take any action that may be required urgently.

When it comes to children disputes, if necessary, a Child Arrangements Order can be obtained from the Court to decide who the children should live with and how often they should spend time with the other parent . While the aim is for parents to decide these arrangements together by themselves or at mediation without the need for a Court Order, sometimes there are disputes which are more difficult to resolve, and in that case, we can assist.

It is important to note that the process of divorce and child disputes can be a difficult time, and it is essential to have the right support and guidance throughout the process. A family law solicitor can provide you with the necessary legal advice and support to help you navigate the process and ensure that you get the best possible outcome.
